The service is connected to time tracking, employee monitoring, and increasing productivity.Please read the following carefully.Sidekick reserves the right to update and change the Terms of Use at any time without notice. All new updates, features, and amendments that enhance the current Service, including the release of new features and resources, shall be subject to the “Terms of Use”. Continued use of the Service after any such changes shall constitute your consent to said changes.If you are a company, organization, institution, head of a group of people, you are referred to as “Client”. If you are the end-user of the Service, you are referred to as a “User”. The Agreement is binding to Sidekick and you (Client and/or User). Violation of any of the terms below will result in the termination of your account. If you do not agree to the Agreement or any part of it, do not use the Site and Service.

Registration: For registering you must be human. Accounts registered by bots and other automated methods are not permitted.You must register on the Site to access the Service, and enjoy all the benefits of Sidekick. While registering you agree to provide complete, true and accurate information, as may be required.Upon registering for the service you have to provide an email address and a password. You are responsible for maintaining the confidentiality of your account, user id, and password.You shall never use someone else’s Sidekick account without permission from that User.You must notify Sidekick immediately of any breach of security or unauthorized use of your account.Although Sidekick will not be liable for losses caused by any unauthorized use of your account, you may be liable for the losses of Sidekick or others due to such unauthorized use.This Agreement is invalid where prohibited by law and the right to access the Service is revoked in such jurisdictions.Sidekick may impose limits on certain features and services or restrict User’s access to parts or all of the Services without notice or liability.Sidekick may change, suspend or discontinue the Services, fees, charges etc at any time, including the availability of any feature.You certify to Sidekick that you have full power and authority to enter into the Agreement and if registering on behalf of a company or other entity, that you have been conferred full authority to bind your principal or company.If you are an individual you shall be at least 18 years of age.You also certify that you are legally permitted to use the Service, and you take full responsibility for the selection and use of the Service.

Termination: You hereby acknowledge that you shall use the Service solely for lawful purposes and complying with the Agreement. Violation of any of the terms will result in the termination of your account. Sidekick will not be responsible for the content posted on the Service. You agree to use the Service at your own risk. The Service is provided on an “as is” and “as available” basis.You acknowledge that you have the required legal capacity to use the Service and be liable on the execution of the Agreement. You must not violate any laws in your jurisdiction. Sidekick reserves the right to refuse service to anyone for any reason at any time.Sidekick, in its sole discretion, has the right to suspend or terminate your account and refuse any and all current or future use of the Service, or any other Sidekick service, for any reason, at any time. Such termination of the Service will result in the deactivation or deletion of your Account or access to your Account, and the forfeiture and relinquishment of all content in your Account.

Modifications: Sidekick reserves the right to modify, suspend, or discontinue the Service or any part thereof at any time, with or without notice. Sidekick shall not be liable to you or to any third party for any modification, suspension, or discontinuation of the Service.ContentAll content on the Service, including but not limited to text, graphics, logos, images, and software, is the property of Sidekick or its content suppliers and is protected by copyright and other intellectual property laws. The collection, arrangement, and assembly of all content on the Service are the exclusive property of Sidekick and are protected by copyright and other intellectual property laws.You may view, download, and print pages from the Service for your own personal, non-commercial use, provided that you do not modify the content and that you retain all copyright and other proprietary notices contained in the content. You may not sell, license, rent, or otherwise use or exploit any content on the Service for commercial use or in any way that violates the rights of Sidekick or any third party.Limitation of LiabilityUnder no circumstances shall Sidekick be liable for any direct, indirect, incidental, special, or consequential damages that result from the use of or inability to use the Service, including but not limited to reliance by a User on any information obtained from the Service or that result from mistakes, omissions, interruptions, deletion of files or email, errors, defects, viruses, delays in operation or transmission, or any failure of performance, whether or not resulting from acts of God, communications failure, theft, destruction, or unauthorized access to Sidekick’s records, programs, or services.Governing LawThis Agreement shall be governed by and construed in accordance with the laws of the State of California, without giving effect to any principles of conflicts of law. You agree that any action at law or in equity arising out of or relating to this Agreement shall be filed only in the state and federal courts located in Santa Clara County, California and you hereby consent and submit to the personal jurisdiction of such courts for the purposes of litigating any such action.

Severability: If any provision of this Agreement shall be deemed unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this Agreement and shall not affect the validity and enforceability of any remaining provisions.Entire AgreementThis Agreement constitutes the entire agreement between you and Sidekick and governs your use of the Service, superseding any prior agreements between you and Sidekick. You may also be subject to additional terms and conditions that may apply when you use or purchase certain other Sidekick services, affiliate services, third-party content, or third-party software.
